Al parecer el juzgado de lo social número 3 de Santander considera que sí. El trabajador tuvo una caída, tropezó y se hirió la mano con el cristal de una puerta en el momento en que realizaba un breve descanso dentro de su horario laboral en teletrabajo.
¿Reconoce el juez el accidente laboral en el hogar del trabajador durante la jornada laboral?
El juez entiende que el accidente ocurrió en el tiempo y lugar de trabajo. Como el accidente fue en el hogar del trabajador, la mutua y el INSS argumentaron que no se podía demostrar que el trabajador se encontrara, en el momento del suceso, en un descanso y que pudo ocasionarse mientras éste realizaba tareas domésticas en su hogar.
El juez no de acuerdo con este argumento les planteó que si el hecho hubiese ocurrido en una empresa no habría existido un procedimiento judicial ni dudas sobre lo ocurrido y que de haber ocurrido el accidente fuera del horario de trabajo estaría de acuerdo con las partes demandadas, pero que el accidente ocurrió durante la jornada de trabajo y añade que no importa lo que estuviera haciendo el trabajador en ese momento, nada cambiaría el momento en que ocurrió el hecho.
El juez les aclaro algunos puntos sobre el tema, como el hecho de que el trabajador se encontraba en medio de un descanso no tenía relevancia, porque si hecho hubiese ocurrido durante el momento de ir al baño, el resultado sería el mismos a menos que se espere que trabajador no acuda durante toda su jornada al baño, no se puede tratar peor a una persona trabajadora en teletrabajo que aun trabajador presencial.
¿Qué pasa si el trabajador alega haber sufrido un accidente laboral durante un breve descanso?
Según la versión sostenida por el trabajador sobre los hechos y el registro informático demuestra que se encontraba prestando sus servicios hasta que tomo el breve descanso y por solo cuestión de minutos se procedió a llamar a la ambulancia, la cual traslado al hospital donde fue atendido.
El inicio del descanso ocurrió a las 19:36 horas mientras que la llegada de la ambulancia a las 19:49 horas. Según lo indicado por el juez.
La sentencia no es firme ya que esta puede ser apelada ante la sala de lo social de Tribunal de justicia de Cantabria.
